Terms of Service

In effect — v1.0, effective 2026-06-30. These Terms govern your use of the Service. Prior open decisions have been resolved (Washington governing law — confirmed as PROTUS NW LLC's home state; 18+ age floor; 14-day refund window; opt-in arbitration). These are self-drafted and not reviewed by outside counsel; a counsel review is recommended before high-volume self-serve, but these are the operative terms as of the effective date.

By creating an account, you ("you", "your", the "user") agree to these Terms of Service (the "Terms") and to our Privacy Policy and Acceptable Use Policy, which are incorporated here by reference.

If you do not agree, do not create an account.


1. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Service. The Service is intended for working professionals and is not offered to minors.

The Service is offered only to residents of the United States. We do not currently accept users resident in the European Economic Area, the United Kingdom, Switzerland, or any other jurisdiction we have not explicitly enabled. If your billing address is outside the United States, Stripe (our payment processor) will refuse the charge.

You may not use the Service if you are barred from receiving services under U.S. law or under the law of your jurisdiction of residence.

2. Your account

You create your account using a valid email address that you control. You are responsible for keeping your password secure, enabling multi-factor authentication when prompted, and for all activity under your account.

Accounts are per-person and non-transferable. You may not share your account credentials with any other person, sell or rent your account, or allow any other person to use your account.

We may suspend or terminate your account for violation of these Terms, the Acceptable Use Policy, or applicable law. See §6.

3. Subscriptions and payments

Some features of the Service require a paid subscription. Available plans, prices, and billing cadence are shown at checkout. By subscribing, you authorize us, via our payment processor Stripe, Inc. ("Stripe"), to charge the payment method you provide.

4. Refunds

You may request a full refund within 14 days of any charge. The fastest way is the customer billing portal; you may also email support@kratos7.com. Refunds are issued to the original payment method via Stripe.

Before initiating a chargeback or payment dispute with your bank, please contact us for a refund first — we honor the 14-day window and can almost always resolve an issue faster than a formal dispute.

Refunds outside the 14-day window are at our discretion and are typically pro-rated for the unused portion.

If we terminate your account for cause under §6 — including violations of the Acceptable Use Policy — you forfeit any unused prepaid portion of the current billing period; a refund you have already earned within the 14-day window is not forfeited. Where a violation is not clear-cut fraud, chargeback abuse, illegal activity, or multi-account abuse, we will give you notice of the specific basis and a reasonable opportunity to cure before terminating.

If we terminate your account without cause, we will pro-rate a refund for the unused portion of the current billing period.

5. License to use the Service

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to access and use the Service for your own training and professional development.

All content we provide — including lab text, drill questions, recipe specifications, rule logic, written explanations, branding, code, and the underlying adaptive engine — remains our property or that of our licensors and is protected by U.S. copyright, trademark, and other intellectual-property law. We grant you a license to use it under these Terms. We do not transfer ownership.

5.1 Your Content

"Your Content" means anything you submit to the Service — including support tickets, feedback, quest, capstone, and QA submissions, and profile fields. You retain ownership of Your Content. You grant us a worldwide, non-exclusive, royalty-free, sublicensable (only to the sub-processors identified in our Privacy Policy) license to host, store, reproduce, transmit, display back to you, grade, and internally route Your Content solely to operate, secure, and support the Service and to enforce the Acceptable Use Policy. This license is operational only — we do not use Your Content for advertising or publicity. You represent that you own or have the necessary rights to what you submit.

6. Account suspension and termination

We may suspend or terminate your account, in whole or in part, with or without notice, if:

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF CONTENT.

We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any defect will be corrected. You assume the entire risk of using the Service for your particular purpose.

The Service is a training platform. It is not a substitute for professional security advice, certification, employment, or any third-party credential. Completing labs, earning proofs, or generating capstone artifacts does not guarantee any employment outcome.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL THE COMPANY, ITS OFFICERS, EMPLOYEES, OR CONTRACTORS BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, WHETHER IN CONTRACT, TORT, OR ANY OTHER THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

The above limitations and exclusions do not apply to: (i) our gross negligence, willful misconduct, or fraud; (ii) liability that cannot be limited under the Washington Consumer Protection Act (RCW 19.86) or other non-waivable consumer-protection law; (iii) death or personal injury caused by our negligence; or (iv) our own indemnification obligations, if any. Conceding these does not affect the enforceability of the limitations for all other claims.

Some jurisdictions do not allow the limitation of certain warranties or liability for consequential damages, so some of the above limitations may not apply to you.

9. Indemnification

You agree to indemnify and hold harmless the Company and its officers, employees, and contractors from third-party claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) to the extent arising out of:

We will promptly notify you of any claim subject to this section. You will not settle any claim in a way that imposes an obligation on us, or admits our fault, without our prior written consent. We may, at our option and expense, assume the defense of any such claim.

10. Dispute resolution

10.1 Governing law

These Terms are governed by the laws of the State of Washington, United States, without regard to its conflict-of-laws principles.

10.2 Informal resolution

Before filing any formal claim, you agree to first contact us at support@kratos7.com and give us a reasonable opportunity (at least 30 days) to resolve the dispute informally.

10.3 Small claims

You retain the right to bring an individual action in small-claims court in your county of residence, if your claim qualifies under that court's jurisdictional limits. Nothing in these Terms waives small-claims rights.

10.4 Optional arbitration

If informal resolution and small-claims do not apply, you may elect — at your option — to resolve the dispute by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, virtually or in the county in the State of Washington where the Company maintains its registered agent. Arbitration is opt-in by you, not required. If you do not elect arbitration, disputes are resolved in the state or federal courts located in that same county, and both parties consent to that jurisdiction.

10.5 Your non-waivable rights

Nothing in this Section 10 deprives you of the mandatory consumer-protection rights of your state of residence that cannot be waived by agreement, or of your right to bring an individual claim in small-claims court. Because arbitration under §10.4 is optional and not required, we do not ask you to waive class, collective, or representative proceedings as a condition of using the Service.

11. General

11.1 Changes to these Terms

We may update these Terms from time to time. Material changes (changes that affect billing, refunds, user rights, prohibited conduct, or dispute resolution) take effect 14 days after we notify you via your account email and a banner in the Service, and continued use after the effective date constitutes acceptance. Non-material changes (typo fixes, link corrections, formatting) take effect immediately.

Each version of these Terms is identified by a version field at the top of this document and an effective_date. Prior versions are preserved in our repository commit history.

11.2 Notices

We send notices to the email address on file for your account. You must keep that address current. You may contact us at support@kratos7.com.

11.3 Assignment

We may assign these Terms to an affiliate or in connection with a merger, acquisition, or sale of assets. You may not assign these Terms without our prior written consent.

11.4 Severability

If any provision of these Terms is held unenforceable, the remaining provisions remain in full force.

11.5 Entire agreement

These Terms, together with the Privacy Policy and Acceptable Use Policy, are the entire agreement between you and the Company regarding the Service, and supersede any prior agreement.

11.6 No waiver

Our failure to enforce any provision of these Terms is not a waiver of our right to do so later.
